Terms of Service and EULA

The service

Daily Spatula publishes home-cooking recipes, allergen labels, guest swaps, and optional account tools such as saved preferences, favorites, and shopping lists. Some tools are free. Shopping lists and region preferences are a paid feature. Checkout is not live. We will not charge a card through this site until a real payment flow is turned on, and a paid flag on an account is not itself a bill.

Accounts

You must give a real email you control and a password of at least 10 characters. You agree to the Terms with the checkbox at signup. Keep your password to yourself. You are responsible for activity under your account. We may refuse, rate-limit, or close an account that we believe is shared, automated, or misused. Google sign-in, when it is enabled, still requires you to accept these terms before account tools are available.

Acceptable use

• Use the service for lawful, personal, family cooking and reading.
• Do not probe, scrape, or overload the site in a way that degrades it for other people.
• Do not upload or send unlawful, deceptive, or abusive material through account tools.
• Do not present our recipes, allergen tags, or diet adjustments as medical advice, a diagnosis, or a certification.
• Do not attempt to bypass human verification, rate limits, or access controls.

Intellectual property

Recipes we write, the fox artwork, the Daily Spatula name, and the site design belong to Grave Danger Media except where a recipe credits another source. You may cook from the recipes at home. You may not copy our text, photos, or artwork for your own site, book, or product without written permission. Recipe credits name the source we relied on. Those sources keep their own rights.

Your account data

Preferences, favorites, and shopping lists are stored so the service can show them back to you. You grant us a limited license to host that material for that purpose. You can request deletion from the account page. See the privacy policy for what we collect.

Not medical advice, and food safety

Recipes, allergen tags, diet labels, guest swaps, and gluten-free or dairy-free adjustments are cooking notes. They are not medical, nutrition, or allergy advice, and they are not a certification that a dish is safe for celiac disease, a food allergy, or any other condition. “Gluten-free” and “dairy-free” on this site mean the recipe is written that way, or that a signed-in member can read an adjusted ingredient list. Packages change. Kitchens share tools. You are responsible for reading labels and deciding what to serve.

Cook food thoroughly, including poultry to 165°F / 74°C unless you are following a different method you already trust. Refrigerate leftovers promptly. We do not control your ingredients, your stove, or your guests.

Disclaimers and liability

The service is provided as-is. To the fullest extent allowed by North Carolina law, Grave Danger Media disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent allowed by that law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from recipes, accounts, or shopping lists. Our total liability for a claim relating to the service is limited to the amount you paid us for the service in the three months before the claim, or fifty U.S. dollars if you paid nothing. We do not exclude liability that North Carolina law does not allow us to exclude, including liability that cannot be waived for injury caused by conduct the law treats as non-waivable.

Termination

You may stop using the service and request account deletion at any time. We may suspend or end access if you break these terms, if we must do so to protect the service or other people, or if we discontinue a feature. Sections that should survive, including intellectual property, disclaimers, liability limits, and governing law, stay in effect.

Marketing email

Recipe emails are optional. The signup checkbox is the consent. You can unsubscribe from the account page, or email hello@dailyspatula.com with the subject “Unsubscribe”. We will stop marketing email after that. Service messages about security or your account may still be sent when we need to reach you.

Governing law

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Courts located in North Carolina are the venue for disputes, except where the law gives you a non-waivable right to a different forum.

Changes

We may update these terms. The date at the top will change. If you have an account, continued use after the update is your acceptance of the new terms. If a change is material, we will also give notice by a site banner or by email when we have your address. The privacy policy is a separate document: Privacy.
